Welcome to True Wealth Co., the brand of TWFP Finserv LLP,  an AMFI-Registered Mutual Fund Distributor (ARN: 308 424) having its registered office in Mumbai, Maharashtra, India. The Company facilitates the distribution of mutual fund schemes and other eligible financial products in accordance with applicable laws and regulations, including the Securities and Exchange Board of India (SEBI) regulations, the AMFI Code of Conduct, and the Digital Personal Data Protection Act, 2023 (DPDP Act).
These Terms & Conditions ("Terms") govern your access to and use of the Company's website, digital platforms, authorised third-party applications, and services.The Terms and Conditions shall be read together with the Company's Privacy Policy and together form an integral part thereof. By accessing or using the Company's website or services, you agree to be bound by these Terms and the Company's Privacy Policy.
  • Definitions

  1. “Company”, “us”, “we” means True Wealth Co./TWFP Finserv LLP. 

  2. “User” means any visitor to the website. 

  3. “Client” means any person availing our services. 

  4. “You” means users/clients.

  5. “Services” mean mutual fund distribution and other financial product distribution services permitted under applicable Laws.

  6. "Incidental Advice" means limited, product-related guidance provided by the Company in its capacity as an AMFI-Registered Mutual Fund Distributor. Such guidance may include information regarding mutual fund schemes, their features, associated risks, and suitability based on an investor's disclosed investment objectives and risk profile, solely to assist the investor in making an informed choice. Incidental Advice does not constitute personalised investment advisory services, detailed financial planning, or holistic investment advice, and should not be construed as such.

  • Acceptance of Terms and Conditions

  1. These terms and conditions are accepted by users of this website/digital platforms/third party application and clients using our mutual fund distribution and other financial product distribution services.

  2. By accessing or using this website, digital platforms, third party applications and services you acknowledge that you have read, understood and accepted these Terms and Conditions and Privacy Policy.

  3. The acceptance states that the user/client of our website/company is legally bound by these terms and conditions and Privacy Policy.

  4. If you do not agree with any provision of these Terms & Conditions or the Privacy Policy, you must immediately discontinue accessing or using the Company's website and services.

  • Terms and Conditions:

  • A. Fulfill fundamental eligibility criteria:

    Users/Clients must be at least 18 years of age or legally authorised to act on behalf of a minor or person under lawful guardianship. 

    B. Provide accurate information:

    You agree and confirm that all information provided by you is true, accurate, complete, and up to date. You further agree to promptly update the Company in the event of any change to such information. Failure to provide or maintain accurate information may result in the suspension or termination of the services provided by the Company.

    C. Receive Communications from the Company:

    By providing your contact information, you consent to receive communications from the Company through telephone calls, SMS, email, WhatsApp, or other authorised channels regarding your transactions, service updates, regulatory communications, and other information reasonably necessary for providing our services, in accordance with applicable laws and our Privacy Policy.

    D. Regulatory Compliance:

    You acknowledge that the Company operates in compliance with applicable laws and regulations, including the regulations issued by the Securities and Exchange Board of India (SEBI), the AMFI Code of Conduct, and the Digital Personal Data Protection Act, 2023 (DPDP Act), as amended from time to time.

    E. Regular Plan Distribution:

    You acknowledge that the Company distributes only the Regular Plans of mutual fund schemes and may receive commissions from the respective Asset Management Companies (AMCs) in accordance with applicable laws. Information regarding such commissions shall be made available upon request or as required by applicable regulations.

    F. Amendments to the Terms and Conditions and Privacy Policy:

    You acknowledge and agree that the Company reserves the right to modify, amend, update, replace, or discontinue these Terms & Conditions, in whole or in part, at its sole discretion. Any such changes shall become effective upon their publication on the Company's website, unless otherwise specified. Your continued access to or use of the website/digital platforms/third party applications/services after such changes constitutes your acceptance of the revised Terms & Conditions.

    G. General Acknowledgement:

    By accessing or using the Company's website or services, you agree to be bound by all provisions of these Terms & Conditions, including the disclosures, user responsibilities, service limitations, limitation of liability, Privacy Policy, amendments to these Terms, and any other applicable provisions contained herein.

  • A. Accuracy and Reliability of Information on Website:

    The Company makes reasonable efforts to ensure that the information provided or displayed on its website, applications, and other digital platforms is accurate, complete, and up to date. However, such information is provided on an "as is" and "as available" basis, and the Company makes no representation or warranty, whether express or implied, regarding its accuracy, completeness, reliability, suitability, or fitness for any particular purpose.

    B. Scope of Services:

    The Company operates on an execution-only basis and may provide incidental advice as permitted under applicable regulations. Such advice is limited to mutual fund scheme-related information and does not constitute personalised investment advice, detailed financial planning, or any recommendation requiring the Company to make investment decisions on behalf of the investor.

    C. Nature of Recommendations:

    Any information, guidance, or incidental advice provided by the Company is intended solely to assist users/clients in understanding mutual fund products and making informed investment decisions. Such guidance is non-binding in nature and should not be construed as a recommendation requiring acceptance. All investment decisions are made solely at the discretion of the user/clients, taking into account their individual circumstances and prevailing market conditions.

    D.  Mutual Fund Risk Disclosure:

    Mutual Fund investments are subject to market risks, read all scheme related documents carefully.

    E. No Guarantee of Returns:

    The Company does not guarantee or warrant any protection against losses arising from market volatility or the risks associated with any financial product. Users acknowledge that all investments are subject to market risks, and any gains or losses arising from such investments shall be borne solely by the investor.

    F. Reliance on Website Information:

    The Company makes no guarantee or warranty regarding the accuracy, completeness, or suitability of the information available on its website/digital platforms/ third-party platforms. Any reliance on such information shall be at the user's/client’s own risk.

    G. Responsibility for Investment Decisions:

    All investment decisions, including the purchase, redemption, switching, or holding of any financial product, are made solely at the discretion of the user, client, or investor. The Company does not make investment decisions on behalf of its clients. The Company's role is limited to facilitating the execution of transactions and providing scheme-related information, product features, associated risks, and incidental advice to the extent permitted under applicable laws and regulations.

    H. No Legal, Tax or Investment Advice:

    The user acknowledges that the information provided or displayed on the Company's website or any authorised third-party platform is intended solely for general informational purposes and does not constitute legal, tax, financial, accounting, or investment advice. Users are advised to seek independent professional advice before making any decision based on such information.

  • A. Providing Accurate Information:

    The user is responsible for providing complete, accurate, true, and current information to the Company and shall promptly update any information that becomes inaccurate, incomplete, or outdated. 

    B.Responsible Use of Website/Digital Platforms/Third Party Application Content:

    The user shall not misuse, copy, reproduce, modify, distribute, publish, or otherwise use any information, content, or material provided or displayed on the Company's website or any authorised third-party platform in any manner that is unlawful, unauthorised, or inconsistent with these Terms & Conditions.

    C. Respect for Intellectual Property:

    The user shall not infringe, misuse, copy, reproduce, modify, distribute, publish, or otherwise violate the intellectual property rights associated with the Company's name, logo, trademarks, branding, website, content, or any material available on the Company's website or authorised third-party platforms without the Company's prior written consent.

    D. Unauthorised Access:

    The user shall not attempt to gain unauthorised access to any password-protected, restricted, or secure areas of the Company's website, systems, applications, or any authorised third-party platform, nor attempt to bypass or interfere with any security measures implemented by the Company.

    E. Eligibility and Legal Capacity:

    The user represents and warrants that they are at least 18 years of age and legally competent to enter into a binding agreement. Where the user is a minor or a person represented by a lawful guardian, access to the Company's services shall be permitted only through or with the verifiable consent of the parent or lawful guardian, as required under applicable law.

    F. Protection of Digital Infrastructure:

    The user shall respect the integrity, security, and proper functioning of the Company's website, applications, systems, and authorised third-party platforms. The user shall not introduce or transmit any virus, malware, malicious code, harmful software, or engage in any activity that may disrupt, interfere with, damage, impair, or compromise the availability, functionality, security, or integrity of the Company's digital infrastructure or services.

  • A. Regulatory Compliance:

    The Company is an AMFI-Registered Mutual Fund Distributor and conducts its business in accordance with applicable SEBI regulations, the AMFI Code of Conduct, the Digital Personal Data Protection Act, 2023, and other applicable laws. The Company is authorised to distribute mutual fund schemes and other financial products for which it holds the necessary registrations or approvals. The Company is not registered as a SEBI Investment Adviser and, accordingly, does not provide investment advisory services, detailed financial planning, or holistic investment advice. It may, however, provide incidental advice to the extent permitted under applicable laws and regulations.

    B. Execution-Only Distribution Services:

    The Company's services are limited to facilitating the execution of transactions and providing incidental advice, including information relating to mutual fund schemes and other financial products distributed by the Company, their features, associated risks, and suitability based on the client's disclosed investment objectives and risk profile, to the extent permitted under applicable laws and regulations.

    C. No Guarantee of Returns or Loss Protection:

    The Company does not provide any guarantee, warranty, or assurance regarding the performance of any financial product, including any financial gains or protection against losses. Users acknowledge that investments in financial products are subject to market risks and uncertainties, and all investment outcomes shall depend on prevailing market conditions and other relevant factors.

    D.  No Authority to Make Investment Decisions:

    The Company shall not make investment decisions on behalf of any user or client. All investment decisions, including the selection, purchase, redemption, switching, or holding of financial products, shall remain solely the responsibility of the investor.

    E. No Guarantee of Product Availability:

    The availability of any financial product, scheme, or investment opportunity shall be subject to the policies of the respective issuer, Asset Management Company (AMC), regulatory requirements, and prevailing market conditions. The Company does not guarantee the continued availability of any particular financial product or scheme.

    F. Execution Subject to Acceptance:

    The execution of any transaction shall be subject to the acceptance, processing, and approval of the relevant Asset Management Company, Registrar and Transfer Agent (RTA), or any other authorised intermediary, as applicable. The Company shall not be responsible for delays or rejection of transactions by such entities.

    G. Dependence on Third-Party Systems:

    Certain services may depend upon the systems, platforms, or infrastructure of Asset Management Companies, Registrars and Transfer Agents, payment gateways, depositories, or other authorised third-party service providers. The Company shall not be responsible for any interruption, delay, or failure caused by such third-party systems.

    H. Regulatory Changes:

    The scope of the Company's services may change from time to time in accordance with amendments to applicable laws, regulations, regulatory guidelines, or directions issued by competent authorities.

    I. No Performance Commitment:

    The Company shall not make or be deemed to have made any commitment, assurance, or representation regarding the future performance, returns, or suitability of any financial product beyond the information officially provided by the respective issuer or Asset Management Company.

  • A. Accuracy of User Information:

    The Company shall not be liable for any loss, damage, claim, expense, or other consequences arising from the user's failure to provide accurate, complete, or up-to-date information including information regarding  fundamental eligibility criteria , or from the user's failure to promptly notify the Company of any changes to such information.

    B. Investment Decision Disclaimer:

    The Company shall not be liable for any loss, damage, claim, cost, or adverse consequence arising from any investment decision made by the user in reliance upon the information, content, or materials available on the Company's website, digital platforms, or authorised third-party applications. Any such investment decision shall be made solely at the user's own discretion and responsibility, to the extent permitted under applicable law.

    C. User’s/Client’s/Investor’s Misconduct:

    A.  The Company shall not be liable for any loss, damage, claim, expense, or consequence arising from inaccurate, incomplete, or outdated information provided by the user, client, or investor, or from the user's failure to promptly update such information. The Company shall also not be liable for any loss or damage arising from the unauthorised acts, misuse, fraud, or misconduct of any person beyond the Company's reasonable control.

    B. The Company shall not be liable for any loss, damage, claim, expense, or consequence arising from the unlawful, fraudulent, negligent, or unauthorised acts or omissions of the user, client, or investor, irrespective of whether accurate information was initially provided to the Company.

    D.  Market Risk:

    The Company shall not be liable for any loss, damage, claim, expense, or adverse consequence arising from market fluctuations or the inherent risks associated with investments in financial products.

    E. Technical Interruptions:

    The Company shall not be liable for any loss, damage, claim, expense, or adverse consequence arising from the unavailability of the website, system downtime, technical errors, system malfunctions, maintenance activities, internet connectivity issues, or interruptions or failures of any authorised third-party platform or service provider.

    F. Third-Party Service Providers:

    The Company shall not be liable for any loss, damage, delay, or failure arising from the acts, omissions, systems, or services of Asset Management Companies (AMCs), Registrars and Transfer Agents (RTAs), payment gateways, banks, depositories, or any other authorised third-party service providers.

    G. Regulatory Changes:

    The Company shall not be liable for any loss, inconvenience, or consequence arising from changes in applicable laws, regulations, regulatory guidelines, circulars, or directions issued by competent authorities that affect the Company's services or the availability of any financial product.

    H. Force Majeure:

    The Company shall not be liable for any delay, interruption, or failure in the performance of its services arising from events beyond its reasonable control, including but not limited to natural disasters, acts of God, war, civil unrest, strikes, governmental actions, pandemics, power failures, internet outages, or other unforeseen events.

    I. Cybersecurity Incidents:

    The Company shall not be liable for any loss or damage arising from cyberattacks, hacking attempts, malware, ransomware, phishing, or other cybersecurity incidents beyond the Company's reasonable control, provided that the Company has taken reasonable security measures in accordance with applicable laws.

    J. Delayed Processing:

    The Company shall not be liable for any loss arising from delays in processing transactions due to banking systems, payment gateways, Asset Management Companies, Registrars and Transfer Agents, regulatory requirements, or any other authorised third-party service providers.

  • A. Ownership of Intellectual Property:

    The Company owns or is lawfully licensed to use all intellectual property displayed on or made available through its website, digital platforms, or authorised third-party applications, including but not limited to its brand name, registered business name, logo, trademarks, trade names, website design, graphics, infographics, text, blogs, articles, images, videos, documents, downloadable materials, software, and other proprietary content. Such intellectual property is protected under applicable intellectual property laws, and all rights therein are reserved by the Company or the respective rights holder.

    B. Protection of Intellectual Property:

    All intellectual property rights in the Company's brand name, registered business name, logo, trademarks, website design, content, graphics, blogs, articles, and other proprietary materials are expressly reserved. No person shall copy, reproduce, modify, distribute, publish, display, transmit, commercially exploit, or otherwise use any such intellectual property without the Company's prior written permission.

    C. Prohibited Use of Intellectual Property:

    The user shall not copy, reproduce, modify, distribute, publish, sell, license, commercially exploit, reverse engineer, create derivative works from, or otherwise use any intellectual property of the Company without obtaining the Company's prior written consent.

    D. Third-Party Intellectual Property:

    Certain trademarks, logos, brand names, software, graphics, or other materials displayed on the Company's website may belong to third parties and are used with permission or under applicable licences. Such intellectual property shall remain the property of their respective owners.

    E. Violation of Intellectual Property Rights:

    Any unauthorised use of the Company's intellectual property may result in the suspension or termination of access to the Company's website or services and may attract appropriate civil or criminal remedies available under applicable law.

  • These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or in connection with these Terms & Conditions, the Company's website, or the services provided by the Company shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India.

  • By accessing, browsing, or using the Company's website or availing any of its services, you acknowledge that you have read, understood, and voluntarily accepted these Terms & Conditions and the Company's Privacy Policy.
